In the state of California, DUI stands for
"driving under the influence of an intoxicating liquor or
drugs." The drugs can even be a legal one in which you
had prescription for.
There is often a lot of confusion around what your
charge actually is, and in the state of California most commonly
you're charged with 2 separate violations, Vehicle code VC 23152
(a) and VC 23152 (b).
23152. (a) It is unlawful for any person who is
under the influence of any alcoholic beverage or drug, or under
the combined influence of any alcoholic beverage and drug, to
drive a vehicle.
23152. (b) It is unlawful for any person who has
0.08 percent or more, by weight, of alcohol in his or her blood to
drive a vehicle.

listed above are separate from any action that the DMV will impose
on your driving privileges. And, in California you have 10
days from the date of the offense to request a DMV hearing to
dispute the suspension of your license. If you do not
request a hearing within that first 10 days your driving
privileges will automatically be suspended.
