SR22 insurance demonstrates proof of financial responsibility. An SR22 is a document that your insurance company files with the state to show that you are, in fact, fully insured.

Many states require that those convicted of a DUI / DWI / OUI carry SR22 insurance. At this time, New York is not one of these states. New York does not require anyone to file SR22 insurance; however, if you have been required to file SR22 insurance in another state and you move to New York, you will want to check with your former state’s DMV and your insurance company, because you might still be required to carry SR22 insurance.

New York Driver’s License Restoration:

If your New York State driver’s license has been revoked because of a DWI (Driving While Impaired), and you have served the full period of your revocation, you can request your license restoration online. If you apply by mail, you cannot do so until 30 days before your revocation ends, and it can take up to 12 weeks before you will receive a response.

New York State’s Ignition Interlock Laws:

In 2009, New York adopted Leandra’s Law, which mandates that anyone convicted of a DWI has an ignition interlock device (IID or BAIID) installed in any vehicle that he or she owns or operates, and must keep the IID installed for a minimum of six months.

An ignition interlock device is a small unit that is wired to your ignition. In order to start an IID-equipped vehicle, you must blow into the device and your breath sample must not register higher than the preset limit of the device. In New York, this preset limit is 0.025. Basically, you cannot consume any alcohol and then start a vehicle. Once the engine is started, the device will continue to ask for additional breath samples at random intervals.

Ignition interlock devices record any failed tests, any failures to submit to tests, e.g., turning off vehicle before providing requested breath sample, and any attempts to tamper with the device. Some devices also include cameras that record who blows into the IID.

It costs about $100 for installation of an IID. One must also keep monthly appointments with his or her IID provider, and these usually cost about $100 each. There may also be a removal fee, which can cost as much as $100.
