A first offense OWI in Iowa comes with a combination of criminal penalties enforced by the court and administrative penalties against your driver's license handed down by the Department of Transportation.
A first offense is classified as a Misdemeanor offense. Punished by imprisonment in the county or municipal jail for a minimum of 48 hours up to a maximum of 1 year. The jail sentence may be suspended by the court as long as you submitted to a chemical test, have had no prior convictions for OWI within the past 12 years and your BAC was less than .15% and have no previous deferred sentences. The maximum fine amount is $1,250 of which the court will waive $625 if you present a temporary restricted license to the court. The court may suspend any fine amount in lieu of community service. Attendance in a state approved substance abuse program is required.
A first offense refusal to submit to a chemical test will result in a 1 year suspension of your driver's license. An ignition interlock will be required if your BAC was .10% or higher or an accident occurred that resulted in the injury of another person. Your license will be revoked for 180 days following a first offense. If you received a deferred sentence the revocation may be reduced to 30 days.
