A second offense OWI in Iowa comes with a combination of criminal penalties enforced by the court and administrative penalties against your driver's license handed down by the Department of Transportation.
A second offense is classified as a Misdemeanor offense. An offense is considered a second if you have been previously convicted of 1 OWI in the past 12 years. Punished by imprisonment in the county or municipal jail for a minimum of 7 days up to a maximum of 2 years. The 7 day minimum is mandatory and cannot be suspended, it must be served. If the court determines that the sentence may create hardship for the offender the court may break the sentence up into 48 hour segments. If the court goes the hardship route they will also add community service to the sentencing. The minimum fine amount is $1,875 up to a maximum of $6,250 plus court costs. The court may order community service in lieu of any fine amount. Attendance in a state approved substance abuse program is required.
A second offense refusal to submit to a chemical test will result in a 2 year revocation of your driver's license. An ignition interlock will be required in order to receive a restricted license from the Department of Transportation. Your license will be revoked for 2 years following a second offense. You will be eligible for a restricted license after serving 45 days of the revocation period with the installation of an ignition interlock.
