Any third or subsequent OWI offense in Iowa comes with a combination of criminal penalties enforced by the court and administrative penalties against your driver's license handed down by the Department of Transportation.

Criminal Penalties

Any third or subsequent OWI conviction is a Class D Felony offense. To be considered a third or subsequent offense you have had 2 previous convictions within the past 12 year period. Punished by imprisonment in the county or municipal jail for a minimum of 30 days up to a maximum of 5 years. The mandatory minimum jail sentence cannot be suspend, it must be served. The minimum fine amount is $3,125 up to a maximum of $9,375 plus court costs. The court may also impound your vehicle for a period of time to be determined by the court. Attendance in a state approved substance abuse program is required.

Administrative Penalties

Any third or subsequent offense refusal to submit to a chemical test will result in a 2 year revocation of your driver's license. An ignition interlock will be required in order to receive a restricted license from the Department of Transportation. Your license will be revoked for 6 years following any third or subsequent offense. You will be eligible for a restricted license after serving 1 year of the revocation period with the installation of an ignition interlock.
