A first offense OUI in Maine comes with a combination of criminal penalties enforced by the court and administrative penalties against your driver's license handed down by the Department of Public Safety.
A first offense is classified as a Misdemeanor offense. There is no mandatory jail time for a first offense as long as there were no aggravating factors and you did not refuse the chemical test. If there were aggravating factors there is a minimum of 48 hours jail time and if you refused the chemical test there is a 96 hours jail sentence. The fine amount will be between $400 and $500 plus court costs. Jail time and fines vary based upon the offenders blood alcohol level. Attendance in a state approved driver education and evaluation program is required.
A first offense refusal to submit to a chemical test will be considered a presumption of guilt and will result in a 275 day suspension of your driver's license. An ignition interlock will be required if you wish to driver during the suspension period. Your license will be suspended for 150 days following a first offense. You will be eligible for a conditional license after 30 days of suspension have been served. The court may grant you a conditional license during suspension period. An ignition interlock will be required in order to receive a conditional license. An SR-22 form filing will be required for a period of 3 years beyond license reinstatement period.
